Clients client didn't like the image, client can't pay me

2pm. Scheduled for 20 minutes. I sent the court and my client a 40 page body of evidence that I can use in the session. They didn't send me anything. I included scans of my article in Professional Photographer, just to point out that I am a professional photographer. All the emails, msn chats saying "We'll pay you tomorrow" and me saying "Its tomorrow no check" and them saying "Oh we sent it?" from last years trouble with them. All the emails / msn from this problem showing how they never said 1 bad thing against the images and were happy. They also said accounting would sort payment. Basically everything to counter all their points. Not professional quality images? Um, Professional Photographer and DSLR User articles :p On page 23 you say you'll pay me. Point out the part where you said you didn't like the images? I will also take my copy of Beyond the lens by the AOP that says how you should be paid even if they don't use the images. I'm also taking a photographer as a witness. I hope the judge has read everything and simply goes "Pay da man" :D

Yeah I've just got everything in there to counter everything they've said, if need be. A lot maybe pointless but if it arises I can say, "turn to page 5."

Don't be surprised if the judge doesn't read everything you've prepared. He'll probably just read the summary and take a view at that point. This depends what the other party have to say or present. Assuming, of course, that they turn up.

How long has been assigned for the hearing?
 
20 minute hearing. I don't expect him to read it all. Theres a contents page, introduction to the content as to why its there and an outline of the issue.
 
Having just spent the morning reading through this entire thread (I did have to keep breaking off to do some work!) I really really hope you win today Pete. Whoever these chumps are they deserve to loose the case and pay you what you earned.

Just read the entire thread and I'm seething on your behalf!

My missus is a solicitor and she always says that, on the whole, the courts take a dim view of big business trying to shaft the little man. Hope your judge has a similar take on things!

What a pain in the @rse, keep us up to date with whats going on, I hope all works out for you mate.
 
So they did turn up. We sat down before the judge and he said that before this goes to trial he needs to get a few questions answered. He wanted to know if this was an issue of quality, regarding the images. They were all ready to fight over T&C's and the judge kept shaking his head and telling them off. I was feeling quite confident at this point. He whipped out my booklet and asked them what was wrong with my photo. They said "Oh well thats only 72dpi" and the judge wasn't impressed by their attempted answer. I quoted from the AOP book, Beyond The Lens, that said if they had a guy with me on the day and didn't direct things then they have no case. If they didn't send a guy, they have no case. They kept saying it wasn't to the brief. I said the brief was wide angle interior shots. They said that the guy couldn't have judged things from a tiny little screen and that they didn't see the cd's for 2 weeks after. Which isn't true as we did the shoot on Friday and I had sent them a link to an online gallery by the following Wednesday. The judge said that we need to agree on an independent photographer who can comment on the quality issue because the judge doesn't have the skill set to do so. They said it would cost £1,000 to hire on and the judge said "You've got £200." I hope that I get this judge again because he did seem to see through them. They kept saying things and he kept saying no. The judge ignored the whole 3rd party thing.

I'm feeling quite depressed about the whole thing now. There is a good chance that I could lose this very easily. The independent photographer could say that they weren't suitable. The AOP say that...

Work may be rejected for the following technical reasons:

iii) The photographer has not produced the details or effects as specified in the brief

I think thats what they're trying to say. I didn't provide images according to the brief. But it took them 2 months to get around to telling me that. Simply put they said that their client didn't like it.

Damn it. I'm remembering things now and I should have fought harder. I should have said that they accepted the images and that there is no quality issue! I'm going to lose this simply because I didn't fight hard enough :( They said they were going to sort payment. If there was an issue then it should have been sorted before that point. Gah! FFS. I should have said. Next court is early new year. Gotta get this independent photographer done by Dec 5th.
 
seriously tho. I still don't think you've got anything to worry about. Their images were very close to yours and the brief is pretty basic so you delivered. If they failed to be specific enough in the brief it's their fault, not yours.

If they behave in a similar way at the next hearing they'll get the same treatment and lose because of it.
